Actualities Surrounding Status of Residence in Japan
Status of Residence for Staying in Japan
To enter Japan, you must undergo an entry screening at the immigration office. At that time, you must prepare and submit documents to obtain a status of residence.
A status of residence categorizes activities that foreign nationals can engage in while staying in Japan or their status or position allowing them to enter and stay in Japan, as defined by the “Immigration Control Act.” There are 28 categories of status of residence based on the purpose of stay.
Foreign nationals who do not fall under these categories are generally not allowed to enter Japan. Therefore, it is a very important procedure for foreign nationals who want to enter Japan. Additionally, after entering Japan, we provide total support for various important milestones in the lives of foreign nationals, such as changing or extending the status of residence due to studying, employment, marriage, or starting a business.
Continuation: What the Status of Residence and Visa are Like in Japan
Status of Residence and Visa are Different
The status of residence system legally defines the qualification to stay in Japan, managing the entry and stay of foreign nationals. The Immigration Control Act stipulates that foreign nationals residing in Japan must have a “status of residence,” unless otherwise specified by the act or other laws. There are 28 defined statuses of residence.
Thus, foreign nationals entering and staying in Japan are granted one of these 28 statuses, and activities within the scope of that status are permitted. [Immigration Bureau HP]
Work Visa and Visa Renewal
People often refer to status of residence as a “visa” (e.g., work visa, marriage visa), but status of residence and visa are entirely different. (This page uses such expressions for simplicity.)
A status of residence grants one of the 28 defined statuses of residence, allowing activities within the scope of that status and providing the basis for staying and working in Japan.
On the other hand, a visa is a document indicating that the person’s passport is valid and that the person is eligible for entry. In many countries, a visa is not a guarantee of entry but a part of the required documents for applying for entry permission.
Types of Status of Residence
There are 28 types of status of residence. They are broadly classified into those related to activities and those related to status or position. There are 24 types related to activities, classified as follows:
- Diplomatic
- Official
- Professor
- Artist
- Journalist
- Highly Skilled Professional
- Business Manager
- Legal/Accounting Services
- Medical Services
- Researcher
- Instructor
- Engineer/Specialist in Humanities/International Services
- Intra-company Transferee
- Nursing Care
- Entertainer
- Skilled Labor
- Technical Intern Training
- Cultural Activities
- Temporary Visitor
- Student
- Trainee
- Dependent
- Designated Activities
Additionally, there are four types related to status or position: Permanent Resident, Spouse or Child of Japanese National, Spouse or Child of Permanent Resident, and Long-Term Resident.
Office Procedures
Certificate of Eligibility Application: Screening for suitability for stay and landing in Japan
The Certificate of Eligibility is issued after the Minister of Justice examines whether a foreign national who intends to enter Japan meets the criteria for a status of residence or landing, based on submitted application documents. If the requirements are met, the certificate is issued.
Extension of Period of Stay Application: Extending the stay period for those staying in Japan
Foreign nationals in Japan are granted a period of stay at the time of status of residence recognition, allowing them to stay within that period. However, they may not necessarily achieve their purpose within that period. In such cases, they need to apply for an extension of the period of stay. If the Minister of Justice grants the extension, they can stay longer. This procedure can be initiated three months before the period expires.
Change of Status of Residence Application: Changing the purpose of stay in Japan
When a foreign national with a status of residence intends to change their purpose of stay to another activity covered by a different status of residence, they must apply for a Change of Status of Residence. For example, a foreign student graduating and securing a job in Japan would need to change from “Student” to a work-permitting status.
Permission for Activities Not Permitted by the Status of Residence Previously Granted: Adding temporary purposes to your stay in Japan
Foreign nationals are not allowed to engage in activities beyond the scope of their status of residence for remuneration. To do so, they need permission. This application for permission allows temporary or supplementary income-generating activities. For example, a student working part-time to cover tuition and living expenses.
